GolfClubsNow – Insurance & Damage Protection Addendum Policy

1. Overview

This GolfClubsNow Insurance & Damage Protection Policy ("Policy") explains the mandatory insurance and damage program (the "GolfClubsNow Insurance Program") that applies to all confirmed rental transactions ("Bookings") facilitated through the GolfClubsNow platform.

This Policy supplements and is incorporated into the GolfClubsNow Terms and Conditions ("Terms"). Capitalized terms not defined herein have the meanings assigned in the Terms.

Participation in the GolfClubsNow Insurance Program is required for all Bookings. Players may not decline coverage.


2. Role of GolfClubsNow

GolfClubsNow administers the Insurance Program for the purpose of funding and adjudicating equipment damage claims. GolfClubsNow is not:

  • A licensed insurer (unless and until explicitly disclosed),
  • The manufacturer of any Equipment,
  • A guarantor of uninterrupted coverage,
  • A guarantor of full replacement value in all cases.

GolfClubsNow may arrange for coverage through internal funding mechanisms, third-party carriers, agents, underwriters, or administrators now or in the future.


3. Coverage Eligibility

This Policy applies only if all of the following conditions are met:

  • A valid Booking is confirmed on the Platform.
  • Player charges, including Insurance Fees, are successfully processed.
  • Equipment handoff and return occur within the scheduled Booking period.
  • The Caddie submits any claims in accordance with Section 9.

Coverage applies solely to golf clubs and directly associated accessories such as:

  • Golf bags
  • Headcovers
  • Shafts and grips
  • Club sets or partial sets

Coverage does not extend to apparel, GPS devices, rangefinders, carts, vehicles, or personal property owned by Players or third parties.


4. Coverage Scope

4.1 Covered Loss Events

Subject to all exclusions and limitations, the GolfClubsNow Insurance Program may provide reimbursement for physical loss or physical damage to Equipment resulting from:

(a) Accidental Damage, including shaft or head breakage; (b) Third-Party Theft, provided reasonable precautions were taken; (c) Damage During Caddie or Platform-Approved Transit, including delivery or courier services; (d) Weather-Related Damage, limited to sudden and unforeseen events.

Coverage is limited to the lesser of:

(i) Documented repair cost, (ii) Fair market value of affected Equipment, or (iii) Per-Booking policy limits established by GolfClubsNow.

Per-Booking policy limits will be specified in the Listing Summary or Booking Confirmation once finalized.


5. Exclusions

The following are not covered under any circumstance:

  • Intentional damage, including club breakage due to anger or misuse;
  • Cosmetic wear, including minor scuffs, scratches, and grip discoloration;
  • Loss due to non-return, abandonment, or Player disappearance;
  • Damage occurring outside the Booking period;
  • Damage due to failure to secure Equipment (e.g., left unattended in public);
  • Damage arising from unauthorized modification or adjustment;
  • Normal wear and tear, including but not limited to:
    • Groove wear from use,
    • Grip wear or tackiness degradation,
    • Bag fabric wear or zipper malfunction;
  • Damage arising from non-golf activities, including use as tools or props;
  • Business interruption or consequential losses;
  • Injury to persons or property, including bodily injury claims;
  • Loss of Player property or third-party property.

GolfClubsNow reserves the sole right to classify a claimed condition as cosmetic, wear-related, or damage.


6. Player Responsibilities

Players acknowledge and agree to:

  • Use Equipment only for golf-related activities;
  • Return Equipment on or before the scheduled return time;
  • Refrain from negligent, abusive, or improper use;
  • Secure Equipment when unattended (e.g., locked vehicle or storage);
  • Promptly notify the Platform and the Caddie of any damage or loss.

Players authorize GolfClubsNow to charge payment methods for uninsured amounts, uncovered losses, or exclusions.


7. Caddie Responsibilities

Caddies agree to:

  • List Equipment accurately with truthful specifications;
  • Provide Equipment in safe, functional condition;
  • Inspect Equipment immediately upon return;
  • Document return condition with photographs where damage is observed;
  • Submit claims in accordance with Section 9.

Failure to comply may result in denial, reduction, or delay of claims.


8. Insurance Fees and Cost Allocation

Each Booking includes a mandatory Insurance Fee charged to the Player at checkout.

Insurance Fee revenue may be used for:

  • Funding reimbursement payments,
  • Administration of claims,
  • Procurement of future carrier-based insurance solutions,
  • Platform risk mitigation reserves.

Allocation of the Insurance Fee between GolfClubsNow and Caddies shall be disclosed separately in the Payment & Payout Policy.


9. Claims Process

9.1 Submission Requirements

Caddies must submit claims within 48 hours of Equipment return, including:

  • Timestamped photographs of damage,
  • Written description of incident,
  • Booking identifiers,
  • Repair estimates or valuation documents (if available),
  • Police report for theft claims (if applicable).

9.2 Investigation

GolfClubsNow may:

  • Request additional documentation,
  • Contact the Player,
  • Require proof of ownership,
  • Engage repair evaluators or adjusters,
  • Review platform messages and metadata.

9.3 Determination

GolfClubsNow will render a determination in its sole discretion based on:

  • Coverage eligibility,
  • Evidence submitted,
  • Applicable exclusions,
  • Reasonable valuation of Equipment.

Determinations are final and binding.


10. Valuation Standards

Reimbursement for covered claims may be based on:

(a) Repair Cost: where economically feasible; (b) Fair Market Value: based on age, condition, brand, and resale data; or (c) Replacement Cost: where no equivalent used valuation is obtainable.

GolfClubsNow may use third-party data sources including but not limited to reseller marketplaces, club fitters, or golf equipment appraisal platforms.


11. Subrogation Rights

To the extent permitted by law, GolfClubsNow may pursue subrogation against responsible parties. Players and Caddies agree to cooperate in such efforts.


12. Recoveries and Player Liability

Players remain financially responsible for:

  • Excluded losses,
  • Uncovered losses,
  • Fraudulent claims,
  • Intentional damage,
  • Loss due to non-return.

GolfClubsNow may charge authorized payment instruments for such amounts.


13. No Guarantee of Availability

GolfClubsNow does not guarantee:

  • Approval of any claim,
  • Payment within a specific timeframe,
  • Ability to procure third-party insurance,
  • Availability of coverage limits in all jurisdictions.

14. Modifications

GolfClubsNow may modify this Policy at any time. Continued use of the Platform after publication constitutes acceptance of revised terms.
